CMS issued the following notice on Thursday, June 6, 2016:
The Centers for Medicare and Medicaid Services (CMS) is considering expanding its voluntary Medicare Set-Aside Arrangements (MSA) amount review process to include the review of proposed liability insurance (including self-insurance) and no-fault insurance MSA amounts. CMS plans to work closely with the stakeholder community to identify how best to implement this potential expansion. CMS will provide future announcements of the proposal and expects to schedule town hall meetings later this year.

CMS served a reminder that the use of ICD-10 codes has been implemented. All WCMSA proposals, with a date of incident (DOI) on or after October 1st 2015, should be submitted using the new ICD-10 codes. The WCMSA related User Guides and training materials have been updated to include the new ICD-10 information.

Effective October 2015, the CRC will assume recovery efforts for conditional payments where CMS is pursuing recovery directly from a liability insurer (including a self-insured entity), no-fault insurer or workers’ compensation entity is the identified debtor.

The Centers for Medicare and Medicaid Services (CMS) will be transitioning a portion of the Non-Group Health Plan (NGHP) recovery workload from the Benefits Coordination & Recovery Center (BCRC) to its Commercial Repayment Center (CRC).
Effective October 2015, the CRC will assume responsibility for the recovery of conditional payments in those cases whereby CMS is seeking reimbursement directly from the WC compensation, liability insurer, and/or no-fault insurer.
CMS will continue to work with the BCRC on those cases that CMS is seeking reimbursement from the claimant directly.

The implementation of ICD-10 codes for MSA proposals submitted to CMS for approval is scheduled for October 1, 2015. All WCMSA proposals with a date of incident on or after October 1, 2015 should be submitted using the new ICD-10 codes. Updated user guides and training material will be made available on the CMS website upon implementation.
