State of New Jersey no longer requires an MSA for WC approval

The State of NJ announced today—

With respect to conditional payments:

Judges and pertinent parties should continue to ensure that the CMS process is initiated in all NJ WC cases where the petitioner is Medicare entitled (enrolled) but will no longer require CMS Attachments A and B to be the only acceptable language.

With respect to MSA arrangements:

CMS and the Justice Department have now taken the position that although a proposed WCMSA is not legally required, it is still recommended as the approval of a WCMSA is final, assured to have met CMS standards, and will not be challenged later.
