CMS Issues New Self-Administration Tool Kit

CMS has issued a new Self-Administration Tool Kit for Workers’ Compensation Medicare Set-Aside Arrangements (WCMSA) version 1.3.  Changes from the prior version of the Tool Kit  include new information on the enhancement of the WCMSA Portal allowing the beneficiary,  his/her representative, or other identified administrator to electronically file yearly attestation statements.  In addition, Section 10 of the Toolkit entitled “Inheritance” now states that the Regional Office and the BCRC will ensure that bills related to the workers’ compensation claim have been paid.  This may involve holding the WCMSA open for a period of time after the date of death, as health care providers have up to 12 months from the date of service to submit a bill.  The prior Tool Kit put the burden on the estate to pay outstanding liens and did not include the 12 month caveat.  The Tool Kit also includes sample form letters for the claimant to utilize throughout the administration process.  A copy of the new Self-Administration Tool Kit can be found here
