CMS Updates Regarding MSP Compliance Operations

March 25, 2020 –

NuQuest has reached out to CMS to confirm operation functions for both conditional lien recovery and Workers’ Compensation Medicare Set-Aside submissions and approvals.  In addition, to our prior blog posting regarding CMS accepting electronic signatures that comply with the ESIGN Act, CMS has also confirmed the following:

  • The WCRC is fully functional and WCMSAs are being reviewed and processed as normal;
  • The BCRC and CRC are fully functional and all processes are being performed as usual;
  • CMS continues to monitor the COB&R operations on a daily basis and is currently functioning in a “business as usual” mode;
  • If changes in COB&R operations need to be applied, notification to external stakeholders will be provided on the COB&R portion of the CMS.gov website;
  • All COB&R contractors (BCRC, CRC, WCRC and supporting contractors), as well at the Regional Offices are staffed; and
  • All COB&R contractors have instituted work remote options for all applicable employees. All workloads and service levels with the COB&R contractors are being closely monitored to ensure accurate and timely responses.
