October 2019 Proposed Rulemaking Changes

As previously reported by NuQuest, read here, the Department of Health and Human Services/ Centers for Medicare and Medicaid Services  issued Notice of Proposed Rulemaking (NPRM)  in December 2018 involving Medicare Section 111 Monetary Penalties (Civil Monetary Penalties and Medicare Secondary Payer Reporting Requirements) and no-fault, liability and workers’ compensation Medicare obligations for future medicals (Miscellaneous Medicare Secondary Payer Clarifications and Updates).  The release date for the NPRM was listed as September 2019.  The Office of Management and Budget issued an updated Agency Rule List-Spring 2019 for the Department of Health and Human Services/CMS stating that the NPRM for both proposed rules is now October 2019.  In addition, the abstract for Miscellaneous Medicare Secondary Payer Clarifications and Updates no longer contains verbiage addressing liability, no-fault, and workers’ compensation settlements, judgments awards, and other payments.  Links to these updates are as follows:
