Reminder: New Consent To Release Language Required by CMS on 04/01/2020

March 18, 2020 –

As a reminder, beginning April 1, 2020,  new language will need to be included in the Consent to Release Note that is required for all CMS Workers’ Compensation Medicare Set-Aside (WCMSA) submissions.  The additional language  that the claimant will need to initial is as follows:

“Further, I have had the Workers’ Compensation Medicare Set-Aside Arrangement need and process explained to me, and I approve the contents of the submission.
Beneficiary initials_______.”

Consents that do not contain this additional verbiage will not be accepted by CMS and will delay the submission process.  Now more than ever is the time to ensure that WCMSA submission packages include only those items that are required for CMS review.  The parties should not be including extraneous items such as privileged information, reserve amounts, settlement amounts that are inconsistent with the parties’ discussions, or other documents that have not been subject to discovery.
